Terms of Service

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. By creating an account or using PMHNP Helper ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms include a binding arbitration clause and a class action waiver in Section 12 below, which affect your legal rights.

1. The service

PMHNP Helper provides interactive, fictional clinical case studies, practice questions, medication guides, and related educational content for educational purposes only. The Service is intended for licensed or student Psychiatric Mental Health Nurse Practitioners and other mental health professionals seeking to practice clinical reasoning. The Service is a study tool and is not a primary prescribing reference or clinical decision support system. All cases are fictional and do not represent real patients. See our Disclaimer for full details.

2. Accounts

You are responsible for maintaining the security of your account credentials. You may not share your account with others or allow others to access the Service through your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and billing

Access to premium content requires a paid subscription or a one-time purchase. By subscribing, you authorize us to charge the applicable fee to your payment method on a recurring basis (monthly or annually, depending on your selected plan). Payment processing is handled by Stripe, Inc. and is subject to Stripe's Terms of Service.

Cancellation: You may cancel your subscription at any time through your account page or the Stripe customer portal. Cancellation takes effect at the end of the current billing period. You will retain access until that period ends.

Refunds: We do not offer refunds for partial billing periods or one-time purchases. If you believe you were charged in error, email support@pmhnphelper.com within 30 days of the charge, and we will review your case and respond within 10 business days.

4. Lifetime Access

The Lifetime Access plan is a one-time purchase of $499 that grants you permanent, non-expiring access to all content and features available on PMHNP Helper at the time of your purchase. This includes all interactive clinical case studies, practice questions, and First Year PMHNP clinical guidance pathways that exist on the platform on the date of your purchase.

Scope of access: Lifetime Access covers all content and features that are part of the PMHNP Helper platform at the time of purchase. New content that is added to existing product categories (e.g., additional case studies, new practice questions, new guided pathways) after your purchase date is included at no additional cost.

Future products: If PMHNP Helper introduces fundamentally new products, services, or product categories that are separate from the existing platform offerings (e.g., live coaching programs, cohort-based courses, or entirely new standalone products), these may require a separate purchase and are not automatically included in Lifetime Access.

Non-transferable: Lifetime Access is tied to your individual account and may not be transferred, resold, or shared with other users.

Service changes: PMHNP Helper reserves the right to modify, suspend, or discontinue any part of the Service at any time. Lifetime Access refers to access to the Service as it exists and evolves and does not guarantee the continued availability of any specific feature.

5. Acceptable use

You may not: reproduce, redistribute, or publicly display the case content without written permission; use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or its systems; or use automated tools to scrape or download content.

6. Intellectual property

All content on PMHNP Helper, including but not limited to clinical case studies, practice questions, medication guides, text, graphics, and software, is the property of PMHNP Helper or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. Your subscription or purchase grants you a personal, non-exclusive, non-transferable, revocable license to access the content for your own educational use. This license does not grant you the right to reproduce, redistribute, or resell the content.

7. Copyright infringement (DMCA)

We respect the intellectual property rights of others and expect our users to do the same. If you believe that content on PMHNP Helper infringes your copyright, please send a notice to our Designated Copyright Agent containing:

  1. A physical or electronic signature of the copyright owner or authorized agent;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, with enough detail to locate it;
  4. Your contact information (address, phone number, email);
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

PMHNP HELPER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. PMHNP HELPER DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CLINICAL, PHARMACOLOGICAL, OR DIAGNOSTIC INFORMATION PROVIDED THROUGH THE SERVICE.

THE CONTENT ON THIS SITE IS FOR EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL ADVICE, CLINICAL GUIDANCE, OR A STANDARD OF CARE. NO PROVIDER-PATIENT RELATIONSHIP IS CREATED BY USE OF THIS SERVICE. YOU ASSUME ALL RESPONSIBILITY FOR CLINICAL DECISIONS MADE IN YOUR PROFESSIONAL PRACTICE.

YOU AGREE THAT THE SERVICE IS NOT INTENDED TO BE RELIED UPON AS A PRIMARY CLINICAL REFERENCE OR PRESCRIBING RESOURCE AND THAT AUTHORITATIVE REFERENCES MUST BE CONSULTED BEFORE ANY CLINICAL APPLICATION.

PMHNP HELPER DOES NOT GUARANTEE EXAMINATION RESULTS, CERTIFICATION OUTCOMES, OR PROFESSIONAL SUCCESS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PMHNP HELPER, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF PMHNP HELPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, PMHNP HELPER SHALL NOT BE LIABLE FOR ANY CLINICAL OUTCOMES, PATIENT HARM, OR PROFESSIONAL CONSEQUENCES RESULTING FROM ANY USE OF OR RELIANCE ON CONTENT PROVIDED THROUGH THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PMHNP HELPER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless PMHNP Helper, its owners, officers, directors, employees, agents, contributors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any clinical decisions you make based in whole or in part on content provided through the Service.

11. Governing law

These Terms and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Dispute resolution and arbitration

Informal resolution first: Before filing any formal proceeding, you agree to first contact us at legal@pmhnphelper.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration: If the dispute is not resolved informally, you and PMHNP Helper agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in the State of California. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver: YOU AND PMHNP HELPER AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Small claims exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdictional amount.

Opt-out: You may opt out of this arbitration agreement by sending written notice to legal@pmhnphelper.com within 30 days of first accepting these Terms. If you opt out, the exclusive jurisdiction for disputes shall be the state and federal courts located in the State of California.

13. General provisions

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Entire agreement: These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and PMHNP Helper regarding the Service and supersede all prior agreements and understandings.

Waiver: The failure of PMHNP Helper to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14. Changes to these terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you by posting a notice on the Service and, where possible, by email. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service.
