Terms of Service

PLEASE READ THESE TERMS CAREFULLY. By creating an account or using PMHNP Helper (the "Service"), you agree to these Terms. These Terms include a binding arbitration clause and class action waiver in Section 12.

1. Educational service

PMHNP Helper provides board-preparation materials, fictional clinical case studies, practice questions, medication learning materials, flashcards, and related educational content. The Service is a study tool. It is not medical advice, clinical decision support, a prescribing reference, a substitute for supervision, or a standard of care. Do not enter patient information into the Service. See our Disclaimer.

2. Accounts

You are responsible for your account credentials and activity. You may not share accounts, attempt unauthorized access, scrape the Service, or use the Service in a way that interferes with other users or our systems.

3. Subscriptions, one-time purchases, and billing

Some content is free and some requires a subscription or one-time purchase. Current prices, included features, access periods, and any product-specific refund promise are shown at checkout or on the applicable offer page. Recurring subscriptions continue until canceled. Stripe processes payments; we do not store your payment-card details.

Cancellation: You may cancel a recurring subscription through your account or the Stripe customer portal. Cancellation takes effect at the end of the current billing period.

Refunds: We honor any product-specific refund promise displayed when you purchase. Otherwise, except where required by law, we do not provide refunds for partial billing periods or one-time purchases. For billing errors or refund requests, contact support@pmhnphelper.com.

4. Retired and legacy products

Products that are no longer offered for sale may remain available to eligible prior purchasers according to the terms presented when they purchased. A retired product is not a current offer. We may modify, replace, suspend, or discontinue Service features while honoring applicable contractual and legal obligations.

5. Educational-use restrictions

You may use the Service for your own educational purposes. You may not reproduce, redistribute, publicly display, resell, or create competing products from Service content without written permission. You may not submit patient-identifying or confidential clinical information.

6. Intellectual property and trademarks

PMHNP Helper content and software are protected by intellectual-property laws. ANCC, PMHNP-BC, AANPCB, PMHNP-C, and related names are the property of their respective owners. PMHNP Helper is not affiliated with, endorsed by, or sponsored by ANCC, AANPCB, or any certification body.

7. Copyright notices

For copyright concerns, email support@pmhnphelper.com with the work, the material at issue, your contact information, your good-faith statement, and your signature or authorization.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Clinical, pharmacological, diagnostic, legal, and examination information may change or contain errors. Verify authoritative sources before clinical application. We do not guarantee examination results, certification outcomes, or professional success.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PMHNP HELPER AND ITS OWNERS, CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR CLINICAL OUTCOMES, PATIENT HARM, OR PROFESSIONAL CONSEQUENCES RESULTING FROM USE OF OR RELIANCE ON THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US DURING THE 12 MONTHS BEFORE THE CLAIM OR $100.

10. Indemnification

You agree to indemnify and hold harmless PMHNP Helper and its owners, contributors, and affiliates from claims arising from your misuse of the Service, violation of these Terms, violation of third-party rights, or clinical decisions made in reliance on Service content.

11. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

12. Dispute resolution and arbitration

Before a formal proceeding, contact support@pmhnphelper.com and allow 30 days for informal resolution. Except for eligible small-claims matters, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules.

YOU AND PMHNP HELPER MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

You may opt out of arbitration by emailing support@pmhnphelper.com within 30 days of first accepting these Terms.

13. General provisions

If a provision is unenforceable, the remaining provisions remain effective. These Terms, the Privacy Policy, and the Disclaimer form the agreement concerning the Service.

14. Changes

We may update these Terms. For material changes, we will post notice and request renewed acceptance where appropriate.
